Legal
TERMS AND CONDITIONS
Last updated October 19, 2026
AGREEMENT TO OUR LEGAL TERMS
MarketAI is a trade name, not a company. It is run by one person, a self-employed person established in Spain. In these Legal Terms, “MarketAI,” “we,” “us,” and “our” mean the person who operates MarketAI. Wherever these Legal Terms exclude or limit liability, they protect that person personally, and anyone acting on their behalf, such as helpers and contractors, in the same way.
We operate the website https://app.marketai.trade (the “Site”), the member area on it, the programming interfaces that the MarketAI connector uses, and any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).
Under the name MarketAI we provide systematic, quantitative trading signals, and tools to write your own trading rules. A member follows a feed with a bot. The bot is carried out by the MarketAI connector, software that the member runs on their own computer or server, with their own credentials, and that places orders on the member’s own account at their exchange or broker. We never access that account: we do not hold your funds, we do not ask for or hold any credential for it, we never place orders on it, and we do not see its balance, trades, or positions. Section 1, “OUR SERVICES,” describes the Services in more detail.
You can contact us by email at contact@marketai.trade.
These Legal Terms are a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and us, concerning your access to and use of the Services. You accept them by ticking the box that says so when you redeem your invitation, or when we ask you to accept an updated version. IF YOU DO NOT AGREE WITH THESE LEGAL TERMS, DO NOT USE THE SERVICES.
IMPORTANT RISK NOTICE. TRADING, ESPECIALLY WITH LEVERAGE, IN DERIVATIVES, AND IN CRYPTO-ASSETS, INVOLVES A SUBSTANTIAL RISK OF LOSS. YOU CAN LOSE SOME OR ALL OF THE MONEY YOU TRADE WITH. SIMULATED AND PAST RESULTS DO NOT GUARANTEE FUTURE RESULTS. OUR SIGNALS ARE GENERAL INFORMATION, NOT PERSONALIZED INVESTMENT ADVICE. THE SERVICES AND THE CONNECTOR ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH NO PROMISE OF ANY RESULT. YOU TRADE YOUR OWN ACCOUNT AT YOUR OWN RISK, AND WE ARE NOT LIABLE FOR YOUR TRADING LOSSES, EXCEPT WHERE THE LAW DOES NOT ALLOW THAT LIMIT. PLEASE READ THE “RISK DISCLOSURE,” “NO INVESTMENT ADVICE,” “DISCLAIMER,” AND “LIMITATIONS OF LIABILITY” SECTIONS BEFORE YOU USE THE SERVICES.
The Services are only for people who are at least 18 years old. Persons under the age of 18 may not use the Services or redeem an invitation.
We email you a copy of the version of these Legal Terms that you accept. We recommend that you keep it, or print a copy, for your records.
KEY INFORMATION
The main points, before you agree. The sections named give the full terms.
- Who we are: MarketAI is a trade name of one self-employed person in Spain; contact@marketai.trade.
- What you get: trading signals from the feeds we run, and tools to write your own rules and build your own feeds from them. Your bot follows one feed through the MarketAI connector, which you run yourself. We never access your exchange or broker account. Access is by invitation, and a bot receives signals only after we approve your account (sections 1, 2, 5 and 6).
- Price: free of charge. If we ever introduce fees, we will tell you in advance, and no fee applies to you until you have accepted it (section 7).
- How long: no fixed term. You can close your account at any time (section 16).
- Your right of withdrawal: if you are a consumer, you may withdraw within 14 days without giving a reason (section 8).
- Risk: you can lose some or all of the money in the trading accounts your bots trade (section 9).
- OUR LIABILITY: THE SERVICES, THE SIGNALS, AND THE CONNECTOR ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH NO PROMISE OF ANY RESULT. YOU TRADE AT YOUR OWN RISK, AND WE ARE NOT LIABLE FOR YOUR TRADING LOSSES, EXCEPT WHERE THE LAW DOES NOT ALLOW THAT LIMIT (sections 23 and 24).
- Complaints: email contact@marketai.trade; we answer within one month (section 21).
- Language and law: the contract is in English and governed by Spanish law; if you are a consumer, you keep the protection of the law of the country where you live (sections 20 and 28).
1. OUR SERVICES
What we provide
- Feeds. A feed is what a bot follows. There are two kinds. Our feeds are sets of trading strategies, over one or more markets, that we run and maintain. For each market, they send signals to open or close a long or short position, with a reference price and, where the strategy uses them, stop-loss and take-profit levels. Their signals are produced by statistical and machine-learning models applied to market data, under rules that we set. Your own feeds run rules that you write or copy. They send each bot that follows them a target portfolio: what the bot’s trading account should hold, worked out from the feed’s entries and exits and sized by the bot’s own settings. See “FEEDS AND THE RESULTS WE SHOW.”
- Your rules. Tools to write trading rules, or to copy one of our templates, to build feeds from them on the markets you choose, and to replay them on past market data. See “YOUR RULES AND YOUR OWN FEEDS.”
- Bots and the MarketAI connector. A bot follows one feed for its whole life, at a leverage and with other settings you choose. The MarketAI connector, which you run on your own infrastructure with your own credentials, receives the bot’s signals or targets and places orders on your trading account. See “BOTS AND THE MARKETAI CONNECTOR.”
In these Legal Terms, your “exchange” means the exchange or broker where you hold the account that a bot trades, and your “trading account” means that account.
What we do not do
We do not accept, hold, or transfer money or crypto-assets for anyone. We never access your trading account. We do not ask for, receive, or hold any key, password, or other credential for it, whether read-only or able to trade. We do not read its balance, orders, trades, or positions, and so we do not show its results. We never place orders on it: every order on it is placed by software that you run, or by you.
We are not a broker, dealer, exchange, custodian, investment adviser, portfolio manager, or crypto-asset service provider, and we are not registered with, licensed by, or supervised by any financial regulator. The Services are not designed to be a regulated investment service in any jurisdiction.
Where the Services may be used
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. You are responsible for making sure that your use of the Services, of the MarketAI connector, and of your exchange is lawful where you live.
2. ELIGIBILITY AND ACCESS BY INVITATION
Invitation only. New accounts are opened by invitation only. To open an account you need a one-time invitation code from us. We decide, in our sole discretion, whom we invite. An invitation code opens one account, can be used only once, and is personal to the person we gave it to. You may not sell or transfer an invitation code, or use one that was not given to you.
Who may use the Services. To use the Services, you must:
- be at least 18 years old and able to form a binding contract;
- not be located in, or a national or resident of, a country or territory that is subject to comprehensive sanctions, and not be a person with whom we are prohibited from dealing under any sanctions law; and
- be permitted, under the laws that apply to you, to use the Services and to trade on your exchange.
We do not exclude any other country as such. Your exchange has its own rules on the countries and people it serves, and they apply to you.
Approval before signals. Having an account does not by itself entitle you to receive signals. A bot of yours receives signals only after we have approved your account for trading. We may give, refuse, or withdraw that approval in our sole discretion. Until we approve your account, your bots receive no signals.
Limits. We may limit the number of bots you may create, and we may set other limits on how the Services are used. The limits that apply to you are shown in the Services.
3. YOUR ACCOUNT, PASSWORD, AND BOT TOKENS
When you redeem an invitation, you give us your email address and your invitation code, and you tick two boxes: one to accept these Legal Terms, including the risk disclosure and that MarketAI is not liable for your trading losses, and one to confirm that you are 18 or older. We then create your account and send a private link to your email address, with a copy of these Legal Terms. The link works once and for a limited time. Using it confirms that you control the email address, after which you choose your password. From then on, you enter with your email address and password.
Our record of your acceptance. When you accept these Legal Terms, we record which version you accepted, which version of our Privacy Policy you were shown, when, and the IP address you accepted from. We keep this record as evidence of our contract, as our Privacy Policy describes.
You agree to keep your password confidential and will be responsible for all use of your account and password. An account is for one person, and you may not share it or let anyone else use it.
Bot tokens. Each bot has its own token, which the MarketAI connector uses to identify the bot to us. We show a token only once, when it is created or regenerated. Treat it like a password: anyone who has it can receive your bot’s signals, and you are responsible for any use of it.
If you think your password or a bot token has been exposed, change your password, regenerate the token, and tell us at contact@marketai.trade. You must keep your email address current, because we send the private link, password resets, and notices to it.
4. FEEDS AND THE RESULTS WE SHOW
The signals are general, not personal
Every bot that follows the same feed receives the same signals. On your own feeds, each bot’s target portfolio is sized by that bot’s own settings. Signals and targets do not take into account your financial situation, objectives, experience, or any other personal circumstances, other than the leverage and settings you choose for your bot.
We manage our feeds
We decide which of our feeds we offer, which markets and strategies each of them contains, how they are weighted, and when the models behind them are retrained or replaced. A feed may stop signaling a market for a period, by design. We may change one of our feeds, offer a new one, or withdraw one at any time, with or without notice. When the markets, strategies, or weights of one of our feeds change, the MarketAI connector follows the change. Your own feeds run your rules as you locked them (see “YOUR RULES AND YOUR OWN FEEDS”).
Timeliness
Signals are produced after each price bar closes and are sent over the internet. We do not guarantee that a signal will be produced, that it will be delivered, that it will be delivered on time, or that your exchange will fill an order at or near the reference price. We do not guarantee that you receive a signal at the same time as, or before, any other recipient.
The results we show for a feed
- Simulated results. The history we show for a feed begins with simulated results. They are hypothetical: we produce them by applying the feed’s strategies or rules to past market data and deducting modeled trading costs. No money was traded to produce them. The strategies and rules were chosen while looking at that same history, so simulated results are optimistic, and real results will likely be lower. A feed on markets picked by hand is replayed only on markets that still trade today; markets that failed along the way are not in it, which makes its results more optimistic still. A feed whose rules are a draft has simulated results only.
- Live results. From the date a feed went live (for a feed on your own rules, from when you locked them, or from when you built the feed, if later), its history continues with live results. We calculate them by applying the same method and the same modeled trading costs to the signals the feed actually sent. They are not the results of any member’s account, and they are labeled separately from simulated results.
- Scenarios. The scenarios we show for the next twelve months are produced by replaying the feed’s history in random order many times. Where we say so, they assume weaker results than that history. They assume that the future will resemble the past, which it may not. They are illustrations, not forecasts, targets, or promises.
- Tools. Tools in the Services, such as the playground, that let you try different leverage, amounts, settings, or loss limits replay a feed’s history with the figures you choose. They are not a recommendation of a leverage, an amount, a setting, or a feed for you.
- A bot’s paper portfolio. For a bot on one of your own feeds, we keep a simulated portfolio, run with the bot’s settings on what its feed sent since the bot started. The bot’s target portfolio is what this paper portfolio holds. It is a simulation, not your trading account.
Your own results will differ from the results we show for a feed, for reasons that include your leverage and account size, the prices your exchange fills your orders at, your exchange’s fees, funding payments, and rules, the times your connector was running, and any trading you do in the same account. We do not see your trading account, so we do not show its results.
5. BOTS AND THE MARKETAI CONNECTOR
How a bot trades
A bot is a record in your account that follows one feed, at a leverage and with other settings you choose. To trade a bot, you run the MarketAI connector (the “Connector”) on a computer or server that you control, and you give it your bot’s token and your own credentials for your trading account, which allow it to trade. The Connector receives the bot’s signals or targets from us and places, changes, and closes orders on your trading account automatically, without asking you first.
One feed for the life of a bot
A bot follows the feed you choose when you create it, for its whole life: its feed cannot be changed. To follow another feed, pause the bot (its Connector closes its open positions), then delete it and create a new bot on the other feed. A new bot on one of your own feeds normally starts holding what that feed’s history holds, so its Connector may buy several markets as soon as it starts.
What stays with you
The credentials the Connector trades with stay in the Connector’s configuration on your infrastructure. The Connector does not send them to us, and we never hold them. The Connector sends us only your bot’s token, to receive the bot’s settings, signals, and targets. It does not report your balance, orders, fills, or positions to us, and we do not read them anywhere else. Your funds stay in your trading account at all times.
Leverage and settings
You set the leverage of each bot, within the range we allow. The Connector uses it to size new positions; a change applies to new positions only, and open positions keep their size. Higher leverage means larger positions relative to your account and larger losses when the market moves against them. Your exchange’s own margin and liquidation rules also apply. A bot on one of your own feeds also has settings such as the most one market may hold, a stop-loss and take-profit, and the most it pays above its paper portfolio’s price to catch up. When you change them, its paper portfolio is worked out again with the new settings, and its next target follows it.
When the Connector closes positions
While it is connected, the Connector closes every open position of a bot and stops trading whenever we tell it that the bot stops receiving signals. This happens, among other cases, when you or we pause the bot; when your approval for trading is withdrawn; and when the bot’s feed is withdrawn, deactivated, or stops running. Closing positions at these times may realize losses that would not otherwise have been realized, or cut short gains.
When the Connector stops without closing positions. Deleting a bot, regenerating its token, and suspending or closing your account revoke the bot’s token: the Connector stops and does not reconnect, and any open positions stay open on your trading account. To have a bot’s positions closed, pause the bot first and let the Connector close them, or close them yourself at your exchange.
The Connector can act only while it is running and can reach both us and your exchange. If it is stopped, or cannot connect, it cannot act on signals or close positions, and your positions stay open until the Connector acts or you close them yourself.
Your responsibilities
You are responsible for:
- installing, configuring, running, securing, and updating the Connector, and for the computer or server it runs on and its internet connection;
- keeping the credentials the Connector trades with, and your bot token, secure;
- running one Connector per bot;
- using the trading account a bot trades only for that bot;
- the settings of your trading account, including margin and position settings;
- monitoring your trading account and positions, and intervening when needed;
- every order placed on your trading account, whether by the Connector, by you, or by other software;
- your exchange’s trading fees, funding payments, and other charges, and any taxes on your trading; and
- complying with your exchange’s terms of use.
If you or other software trade the same trading account, the Connector’s behavior and your results may differ from those of the feed.
License to the Connector
We make the Connector available to members, free of charge. Subject to these Legal Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and run it solely to trade your own bots on your own trading accounts, for as long as your account is open. The Connector is part of our Content (see “INTELLECTUAL PROPERTY RIGHTS”). THE CONNECTOR IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND. IT ACTS ON YOUR TRADING ACCOUNT ON YOUR INSTRUCTIONS AND AT YOUR RISK, AND THE “DISCLAIMER” AND “LIMITATIONS OF LIABILITY” SECTIONS APPLY TO IT IN FULL, INCLUDING TO WHAT IT DOES OR FAILS TO DO, ITS ERRORS AND OUTAGES, AND ITS UPDATES.
6. YOUR RULES AND YOUR OWN FEEDS
Rulesets and feeds
You can write a ruleset: rules that say when to buy and when to sell. You can also copy one of our templates; the copy is your own ruleset, either as an editable draft or already locked. A feed is a ruleset and the markets it trades, such as a list of markets or markets you pick by hand.
Drafts and locked rules
A ruleset is a draft until you lock it. A draft can be edited, and it is a sandbox: we replay its feeds on past market data so that you can study them, but no bot follows them. When you choose “Lock the rules,” the ruleset and the markets of its feeds are fixed and never change. To change them, make an editable copy, which is a new draft. A bot can follow only a feed on locked rules, or one of our feeds. A feed on locked rules runs at every bar from then on.
Your rules are your decisions
We run your rules as you wrote or copied them, on our market data. We do not check whether they suit you or whether they will make money. A template is an example, not a recommendation. You are responsible for the rules you lock, for the feeds your bots follow, and for your bots’ settings.
7. PRICE
The Services are provided free of charge. This includes our feeds, the tools for your own rules and feeds, your bots, and the Connector.
If we ever introduce fees, we will tell you in advance by email, and no fee will apply to you until you have accepted it. If you do not accept a fee, you may close your account (see “TERM AND TERMINATION”).
Your own costs
You bear your exchange’s trading fees, funding payments, spreads, and other charges, any taxes on your trading, and the costs of running the Connector.
8. YOUR RIGHT OF WITHDRAWAL
If you are a consumer, you may withdraw from the contract that these Legal Terms make within fourteen (14) days of the day you open your account, without giving any reason.
How to withdraw. Tell us by email at contact@marketai.trade, with a clear statement that you withdraw. You may use the model form below, but you do not have to. It is enough to send your statement before the fourteen days end.
What happens. We close your account: your bots’ tokens stop working and the Connector stops. Open positions stay open, so before you withdraw, pause your bots and let the Connector close their positions, or close them yourself. The Services are free, so withdrawing costs you nothing.
Model withdrawal form. (Complete and return this form only if you wish to withdraw from the contract.)

9. RISK DISCLOSURE
You should use the Services only if you understand the risks below and can afford to lose all of the money in the trading accounts your bots trade. This list does not describe every risk.
- Substantial risk of loss. Trading involves a substantial risk of loss. You can lose some or all of the money you trade with.
- Crypto-assets. The markets our feeds trade include crypto-assets and crypto-asset derivatives. Their prices are highly volatile, trade around the clock, and can move sharply and without warning. Liquidity can disappear. Prices can be affected by regulatory action, technical failures, hacks, and events affecting stablecoins. Crypto-assets are generally not protected by deposit insurance or investor compensation schemes.
- Leverage and derivatives. Leverage magnifies losses as well as gains. With leverage, a small price move can cause a large loss, and your exchange may liquidate your positions. Derivatives may carry funding payments and other costs.
- Simulated results have limits. Simulated results are hypothetical and benefit from hindsight. The strategies or rules behind a feed were chosen using the same history on which their simulated results are calculated, which makes those results optimistic. Simulated results cannot fully account for real trading conditions, such as liquidity, slippage, outages, or how your exchange fills orders, and the trading costs we deduct are estimates.
- Past results do not guarantee future results. Neither simulated nor live results, nor the scenarios we show, guarantee future results. A strategy that was profitable in the past can stop working, and markets change in ways that models may not capture. We may retrain, change, or replace the models behind a feed.
- Execution. Your orders may be filled at worse prices than the reference price, partly filled, delayed, or rejected. Signals are produced after a price bar closes and take time to reach you.
- Technology. The Connector, the computer or server it runs on, the internet, our systems, and your exchange’s systems can fail, be slow, or behave unexpectedly. Software errors, in our systems or in the Connector, including after an update, can cause missed signals, unintended orders, wrong position sizes, or positions that are not closed.
- Interruptions. When a bot stops receiving signals, the Connector closes the bot’s open positions (see “BOTS AND THE MARKETAI CONNECTOR”), which can realize losses at an unfavorable moment. When the Connector stops instead, for example because the bot was deleted, its token revoked, or its computer or network is down, open positions stay open and unmanaged until you close them.
- Your exchange. Your exchange may suffer outages, freeze withdrawals, change its rules, be hacked, suspend your account, or become insolvent. We have no control over your exchange.
- Security. Anyone who obtains the credentials your Connector trades with, or your bot token, may be able to misuse them.
- Concentration. A feed may trade a small number of markets whose prices tend to move together.
- Legal, regulatory, and tax. Laws and regulations on crypto-assets, derivatives, and automated trading change and differ between countries, and may restrict or prohibit your use of the Services or of your exchange. Trading may have tax consequences for you.
YOU BEAR THESE RISKS. YOU TRADE YOUR OWN TRADING ACCOUNT, AT YOUR OWN RISK, AND EVERY GAIN AND LOSS ON IT IS YOURS. AS SECTIONS 23 AND 24 SET OUT, WE ARE NOT LIABLE FOR YOUR TRADING LOSSES, AND YOU AGREE NOT TO CLAIM THEM FROM US, EXCEPT WHERE THE LAW DOES NOT ALLOW THAT LIMIT.
10. NO INVESTMENT ADVICE
The signals, targets, feeds, templates, results, scenarios, tools, and all other information provided on or through the Services are provided for informational purposes only. They are not an offer or a solicitation to buy or sell any asset, and they do not constitute financial, investment, legal, tax, or other professional advice, or a personal recommendation. They do not take into account your objectives, financial situation, knowledge, experience, or needs. We do not guarantee the accuracy, completeness, or reliability of any information presented.
We do not act as your adviser, agent, or fiduciary, and we owe you no fiduciary duty. You alone decide whether to use the Services, which feed a bot follows, the leverage of each bot, and how much money is in the trading accounts your bots trade, and you are solely responsible for those decisions and their results. Please consult a financial advisor before making any investment decisions. Our service is not intended to provide personalized investment recommendations or advice.
Our own trading. We, and the people who work with us, may trade for our own accounts, including by following the same signals as the feeds you follow, with our own connectors. We do so independently of you, and our trades may be placed at the same time as, before, or after yours.
11. INTELLECTUAL PROPERTY RIGHTS

14. SERVICES MANAGEMENT
We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal Terms, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any content you provide or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Services or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services, including by pausing bots and withdrawing trading approval as these Legal Terms describe.
15. PRIVACY POLICY
We care about data privacy and security. Our Privacy Policy, https://app.marketai.trade/privacy/, explains how we process your personal data, who helps us process it, and your rights. We host the Services in Finland, in the European Union.
16. TERM AND TERMINATION
These Legal Terms remain in force while you have an account, with no fixed term.
Closing your account. You may stop using the Services and close your account at any time. To close it, email us at contact@marketai.trade from the email address of your account. Before you do, pause your bots and let the Connector close their positions, or close them yourself; then stop your Connector, and remove at your exchange the credentials it trades with.
When we may suspend or close your account. We may suspend or close your account, and refuse you access to the Services, at once if you seriously or repeatedly breach these Legal Terms, if you breach the law in using the Services, or if the law or an authority requires us to. We may also close your account, or stop providing the Services, for any other reason, by telling you by email at least thirty (30) days in advance. If we close or suspend your account, you may not open a new account under your name, a fake or borrowed name, or the name of any third party, without our permission. We reserve the right to take appropriate legal action, including civil, criminal, and injunctive redress.
What happens when your account ends. When your account is suspended or closed, your bots’ tokens stop working and the Connector stops. Open positions stay open until you close them (see “BOTS AND THE MARKETAI CONNECTOR”). Sections that by their nature should survive termination survive it, including the sections on intellectual property, risk, no investment advice, governing law, complaints and disputes, disclaimer, limitations of liability, and indemnification.
17. MODIFICATIONS AND INTERRUPTIONS
We may change, modify, or remove the contents of the Services at any time. This includes changing or withdrawing our feeds, changing their markets, strategies, and weights, retraining or replacing the models behind them, and changing how the Connector communicates with the Services. However, we have no obligation to update any information on our Services. Changes to these Legal Terms follow “CHANGES TO THESE LEGAL TERMS.”
We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors, including signals that are delayed, missed, or not sent. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time or for any reason. To the extent the law allows, we have no liability for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance of the Services, including any trading loss. Nothing in these Legal Terms will be construed to obligate us to maintain and support the Services or to supply any corrections, updates, or releases in connection therewith.
18. CHANGES TO THESE LEGAL TERMS
We may change these Legal Terms, for example when the Services or the law change. Each version has its own “Last updated” date at the top, and we keep a record of the version you accepted. When we change them, we tell you by email at least fifteen (15) days before the new version takes effect. From then on, we ask you to accept the new version when you use the member area; you may also accept it earlier. Until you accept it, you cannot use the member area, except to pause or delete your bots, but your bots keep running and the Connector keeps trading as before. If you do not want to accept the new version, you may close your account (see “TERM AND TERMINATION”). A change that introduces fees applies to you only once you have accepted it (see “PRICE”).
Supplemental terms or documents that we post on the Services from time to time, and that you accept, form part of these Legal Terms.
19. THIRD-PARTY SERVICES
The Services work with services that third parties provide, including your exchange and the providers that host the Services and handle our emails. Your use of your exchange is governed by the exchange’s own terms, and your relationship with it is solely between you and the exchange. We are not responsible for the acts, omissions, availability, security, or solvency of your exchange or of any other third party. The Services may contain links to third-party websites, which we do not control and for which we are not responsible.
20. GOVERNING LAW AND COURTS
These Legal Terms, and your use of the Services, are governed by the law of Spain.
If you are a consumer, you keep the protection of the mandatory rules of the law of the country where you live; nothing in these Legal Terms takes it away. You may bring proceedings about these Legal Terms or the Services in the courts of the place where you live or in the courts of Spain. We may bring proceedings against you only in the courts of the place where you live.
If you are not a consumer, the courts of the place in Spain where we are established have exclusive jurisdiction.
21. COMPLAINTS AND DISPUTES
If you have a complaint, please email us first at contact@marketai.trade. We will answer as soon as we can, and within one month at the latest, and try to resolve it with you.
We are not bound to use any alternative dispute resolution body, such as consumer arbitration. If you are a consumer, you may also contact the consumer authority where you live. These Legal Terms contain no arbitration agreement, and nothing in them stops you from going to court, whether alone or through a consumer association, as the law allows.
22. CORRECTIONS
There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, results, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.
23. DISCLAIMER
What the law always keeps. Nothing in this section or the next one excludes or limits liability for harm caused intentionally or through gross negligence, for death or personal injury, or any other liability or consumer right that the law does not allow to be excluded or limited, such as under article 86 of Spain’s consumer law (TRLGDCU) or the mandatory law of the country where you live.
THE SERVICES, INCLUDING THE SIGNALS, TARGETS, FEEDS, TEMPLATES, RESULTS, SCENARIOS, TOOLS, AND THE CONNECTOR, ARE PROVIDED FREE OF CHARGE, “AS IS” AND “AS AVAILABLE”, WITH NO PROMISE OF ANY RESULT. TO THE FULLEST EXTENT THE LAW ALLOWS, WE GIVE NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
IN PARTICULAR, WE DO NOT PROMISE THAT:
- ANY SIGNAL, FEED, STRATEGY, RULE, OR TEMPLATE WILL MAKE MONEY, OR WILL NOT LOSE IT;
- ANY RESULT OR SCENARIO WE SHOW WILL BE ACHIEVED, OR IS FREE OF ERRORS;
- SIGNALS AND TARGETS WILL BE RIGHT, OR WILL BE PRODUCED, SENT, OR DELIVERED ON TIME;
- THE CONNECTOR WILL PLACE, CHANGE, OR CLOSE ORDERS AND POSITIONS AS INTENDED, OR WILL RUN WITHOUT ERRORS OR INTERRUPTIONS, BEFORE OR AFTER AN UPDATE;
- THE SERVICES WILL BE AVAILABLE, UNINTERRUPTED, SECURE, OR FREE OF ERRORS.
24. LIMITATIONS OF LIABILITY
YOU TRADE AT YOUR OWN RISK. YOU TRADE YOUR OWN TRADING ACCOUNT, WITH YOUR OWN MONEY, AT YOUR OWN RISK, AND EVERY GAIN AND LOSS ON IT IS YOURS. EXCEPT AS “WHAT THE LAW ALWAYS KEEPS” IN SECTION 23 REQUIRES, WE ARE NOT LIABLE TO YOU OR TO ANYONE ELSE FOR ANY TRADING LOSS, OR ANY OTHER LOSS OR DAMAGE, ARISING FROM OR IN CONNECTION WITH THE SERVICES, WHATEVER ITS CAUSE, INCLUDING:
- MARKET MOVES, VOLATILITY, PRICE GAPS, AND LOW LIQUIDITY;
- SIGNALS OR TARGETS THAT ARE WRONG, LATE, MISSED, OR NOT SENT;
- WHAT THE CONNECTOR DOES OR FAILS TO DO: ORDERS PLACED, CHANGED, OR NOT PLACED; POSITIONS OPENED, CLOSED, OR NOT CLOSED; POSITION SIZES; AND ITS ERRORS, OUTAGES, AND UPDATES;
- YOUR EXCHANGE: ITS OUTAGES, ERRORS, FILLS, FEES, RULES, SUSPENSIONS, SECURITY BREACHES, OR INSOLVENCY;
- LEVERAGE, MARGIN CALLS, AND LIQUIDATIONS;
- YOUR OWN RULES, SETTINGS, CREDENTIALS, COMPUTERS, SERVERS, AND NETWORK, YOUR DECISIONS, AND ANY TRADING THAT YOU OR OTHER SOFTWARE DO ON THE ACCOUNT;
- INTERRUPTIONS, DELAYS, OR THE END OF THE SERVICES, AND ERRORS IN DATA, RESULTS, OR SCENARIOS; AND
- A BOT BEING PAUSED, A FEED BEING CHANGED OR WITHDRAWN, OR YOUR APPROVAL BEING WITHDRAWN, AND THE POSITIONS THE CONNECTOR CLOSES AS A RESULT.
THIS INCLUDES LOST PROFITS, MISSED GAINS, LOSS OF DATA, AND INDIRECT OR CONSEQUENTIAL LOSS. YOU AGREE NOT TO CLAIM YOUR TRADING LOSSES FROM US.
A CAP ON ANYTHING ELSE. WHERE WE ARE LIABLE TO YOU DESPITE THE ABOVE, AND THE LAW ALLOWS A LIMIT, OUR TOTAL LIABILITY FOR ALL CLAIMS TOGETHER IS LIMITED TO ONE HUNDRED EUROS (€100).
Who these limits protect. This section and the previous one protect the person who runs MarketAI personally, and anyone acting on their behalf, such as helpers and contractors.
The law of the country where you live may not allow some of these exclusions or limits. Where it does not, they apply to you as far as that law allows, and the rest of this section still applies.
25. INDEMNIFICATION
To the extent the law allows, you agree to defend, indemnify, and hold us harmless, and anyone acting on our behalf, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Services; (2) breach of these Legal Terms; (3) any breach of your representations and warranties set forth in these Legal Terms; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; (5) any overt harmful act toward any other user of the Services with whom you connected via the Services; or (6) the Connector as you run it, your trading accounts, and your trading. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
26. USER DATA
We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. To the extent the law allows, we have no liability to you for any loss or corruption of any such data.
27. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Services, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SERVICES.
28. LANGUAGE
These Legal Terms are written in English, and the contract between you and us is concluded in English. We keep a record of each version, and of which version you accepted (see “YOUR ACCOUNT, PASSWORD, AND BOT TOKENS”).
29. MISCELLANEOUS
These Legal Terms and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law. We may transfer our rights and obligations under these Legal Terms to another person or business that takes over MarketAI; we will tell you if we do, and your rights under these Legal Terms will not be reduced. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Legal Terms or use of the Services.
